3. Your Status

When placing an order through our website, you confirm that:

You possess the legal capacity to enter into binding contracts.

You are a resident of one of the Serviced Countries.

4. How The Contract Is Formed Between You And Us

Upon placing an order, you’ll receive an email acknowledging its receipt. However, please note that this doesn’t confirm the acceptance of your order. Your order is considered an offer to purchase a product, subject to availability and our acceptance. We’ll send you a separate email, known as the “Dispatch Confirmation,” once the product is dispatched. The Contract between us is formed when the Dispatch Confirmation is sent.

In case of an error with your order, you may have the opportunity to rectify it via email before it is processed. Once your order has been processed, amendments are not possible. If your order has already been dispatched, kindly refer to our Returns Policy for instructions on returning the products to us.

The Contract will specifically pertain to the products for which we have confirmed dispatch in the Dispatch Confirmation. We are not obligated to provide any additional products that may have been included in your order until their dispatch has been confirmed in a separate Dispatch Confirmation.

When making a request, you agree that the information you provide to us for ordering goods or services is truthful and precise. You confirm that you are an authorized user of the credit or debit card used for the request and that there are adequate funds to cover the expenses. It is your responsibility to promptly notify us of any changes to these details.


5. Availability And Delivery

Orders will be delivered by the specified date in the Dispatch Confirmation or within 30 days if no date is mentioned, barring exceptional circumstances.

6. Price And Payment

Prices for the Products displayed on the website include AUS GST.

Payment must be made through the specified means on the website, and it will be considered complete only upon receiving cleared funds for the full amount stated in the order.

While we strive to ensure accurate pricing, there is a possibility of incorrect prices on some Products. We verify prices during dispatch, and if the correct price is lower, we will charge the lower amount. In case the correct price is higher, we may contact you for instructions or reject the order and notify you accordingly.

    8. Our Liability

    In the event of non-delivery, incorrect delivery, damaged or defective products, or incorrect quantity, we will take the following actions at our discretion:

    Rectify any shortage, non-delivery, or incorrect delivery.

    Replace or repair damaged or defective Products.

    Provide a refund for the amount paid for the affected Products.

    We are not liable for any consequential, special, or indirect losses, including but not limited to loss of revenues, profits, contracts, business, anticipated savings, or damage to goodwill, reputation, or data.

    Our total liability under this contract is limited to the amount paid for the Products.

    The Contracts (Rights of Third Parties) Act 1999 does not grant any rights to enforce the terms of this Contract to a person who is not a party to it.

      9. Intellectual Property Rights

      We exclusively own all Intellectual Property Rights related to the Products and Branding.

      10. Indemnity

      You agree to indemnify, defend, and protect BullionCare, along with its directors, officers, employees, consultants, agents, and affiliates, against any third-party claims, liabilities, damages, and costs (including legal fees) resulting from, but not limited to, your violation of these terms and conditions, infringement of intellectual property rights or any other rights of others, breach of confidentiality or privacy, or any defamatory statements made by you.

      11. Import Duty

      When ordering Products for delivery outside Australia, please be aware that import duties and taxes may apply upon delivery. You are responsible for paying these charges. We have no control over the amount and recommend contacting your local customs office for more information. Additionally, please comply with all applicable laws and regulations of the destination country. We are not liable for any breach of such laws by you.

      12. Written Communications

      Applicable laws require written information and communications. When using our site, you agree that communication with us will be mainly electronic. We will contact you via email or by posting notices on our website. By using our site, you accept electronic communication for contractual purposes. All contracts, notices, and information provided electronically comply with legal requirements. Your statutory rights are not affected.

      If any of these terms and conditions or provisions of a contract are deemed invalid, unlawful, or unenforceable, they will be separated to the extent necessary while the remaining terms and provisions remain valid to the fullest extent permitted by law. The applicable policies and terms and conditions are those in effect at the time of your product order, unless required changes are made by law or governmental authority (which may apply to previous orders). If we notify you of any changes before sending the Dispatch Confirmation, we will assume you have accepted the updated terms and conditions unless you notify us otherwise within seven working days of receiving the Products.
